In the article, Michael Beck, MD, FASA, chair of ASA’s Task Force on State Advocacy, wrote about the importance of physician-led anesthesia care and explained the truth about “opt-out” states and how the policy is a “failed experiment that undermines patient safety.” He wrote, “The Centers for Medicare and Medicaid Services (CMS) fully recognizes the authority of state laws and regulations, nearly all of which require supervision or other oversight of nurse anesthetists administering anesthesia. These state laws and regulations exist regardless of federal opt-out.”
