Marking a significant victory for patients, hospitals, and physicians, the Indiana House and Senate passed Senate Bill 189 (SB 189), legislation that prohibits insurers from assessing a fee or penalty when an out-of-network provider administers care. The legislation is now eligible for signature by Governor Mike Braun.
Endorsed by the Indiana Society of Anesthesiologists (ISA) and the American Society of Anesthesiologists (ASA), this landmark legislation labels insurer fees and penalties tied to out-of-network care “unfair and deceptive act[s].” It was introduced in response to Anthem Blue Cross Blue Shield’s policy in several states to impose a 10% reduction in facility payments when hospitals utilize out of network providers. Once signed, the bill will become effective immediately.
By prohibiting insurers from leveraging such punitive tactics, SB 189 safeguards fair contracting, protects independent anesthesiology groups, and helps ensure Hoosiers continue to receive safe, uninterrupted access to anesthesia care.
ASA and ISA applaud the Indiana Legislature for prioritizing patients and reaffirming the importance of equitable insurer practices in preserving high quality anesthesia care statewide.
