The Federal Trade Commission has once again, at the request of members of Congress, delayed the implementation and enforcement of the “Red Flag Rules” intended to protect against identity theft. The new implementation date is December 31, 2010. The original implementation date was November 1, 2008, but required compliance has been extended several times for a variety of reasons, including controversial application of the term “creditors” to certain health care providers. The rule was slated to become effective June 1.
