The ASA joined with the American College of Emergency Physicians and the American College of Radiology to urge the federal government to “expedite the resumption of independent dispute resolution (IDR) payment determinations” or claims disputes. The dispute resolution process was paused on February 10, 2023 in response a successful Texas Medical Association (TMA) lawsuit challenging parts of the implementation of the No Surprises Act. The joint medical organization’s communication to the head of the Center for Consumer Information and Insurance Oversight (CCIIO) highlights the harm to physician practices of both existing and new delays in the processing of payment disputes. “Our members’ practices, particularly small and medium sized community-based practices, are being hurt every day as they provide the needed patient care and then have to await long-delayed payment determinations.” CCIIO is asked make accommodations to physician practices until the IDR entities can restart their payment determinations.
